H-2B Visa

The visa solution for temporary non-agricultural workers

The United States government permits employers, under certain conditions, to authenticate their temporary requirement for workers when they are unable to locate suitable candidates within the country. This is facilitated through the sponsorship of H-2B visas. Subsequently, foreign workers may apply for these visas upon obtaining sponsorship, granting them the opportunity to engage in employment within the United States for a designated duration.

Understanding the H-2B Visa Needs

  • The H-2B visa is a non-immigrant visa for non-agricultural laborers. These visas grant entry to the United States for temporary employment. To acquire an H-2B visa, your U.S. employer or representative must file Form I-129 on your behalf.

If you are a U.S. company seeking to employ a foreign national, you will likely apply for an H-2B visa. It’s important to note that there is a limit of 66,000 H-2B visas available, which are granted on a first-come, first-served basis. Applying for an H-2B visa as soon as possible increases your chances of being approved.

Since the H-2B visa is intended for seasonal workers, there are two application periods during which you can apply:

    – January, with a cap of 33,000 visas
    – June, with a cap of 33,000 visas

Obtaining an H-2B visa allows temporary employment in the United States. The H-2B program offers an excellent opportunity to work in industries that require additional workforce to boost the U.S. economy, ensuring fair compensation for foreign nationals within the legal framework.
